In a ruling on Wednesday, the Federal High Court in Abuja dismissed Senator Jimoh Ibrahim’s case challenging the results of the All Progressives Congress (APC) governorship primary election held in Ondo State on April 20, 2024.

Representing the plaintiff, Mr. Olakunle Lawal informed the court of a notice of withdrawal dated May 27, 2024, filed on May 29, 2024. Counsel for the APC, Matthew Burka, SAN, confirmed receipt of the notice and raised no objections.

Bode Olanipekun, SAN, appearing with Ebun-Olu Adegboruwa, SAN, for Governor Lucky Aiyedatiwa, and Charles Edosomwan, SAN, appearing with Suleiman Ibrahim, SAN, representing the Independent National Electoral Commission (INEC), also acknowledged receipt of the notice and expressed no objections.

Edosomwan emphasized the importance of cooperation between the plaintiff and the Governor, given their political affiliation.

After hearing from all counsel, Justice Inyang Ekwo ruled that since the defendants had engaged with the plaintiff’s claims, the appropriate action was to dismiss the case.

“The proper order to make in the circumstances is to dismiss the case of the plaintiff since the defendants have joined issues with him,” Justice Ekwo ruled.

Consequently, the case was dismissed. Senator Ibrahim had contested the APC primary elections, which declared Governor Lucky Aiyedatiwa the winner on April 20, 2024.
